No designs can be distributed, altered, or unaltered in any format unless stated in the terms & conditions and the image/picture use policies. With limitations, customers can sell items with a GMSity, LLC design(s) sewn onto the product commercially. Written consent is needed for mass marketing items using GMSity, LLC. GMSity, LLC will not be held liable for any monetary losses or consequential damages resulting from using GMSity, LLC design(s).

PRIVACY POLICY

• This privacy notice discloses the privacy practices of GMSity Embroidery. This privacy notice applies solely to information collected by this website.

• Information Collection, Use, and Sharing: GMSity Embroidery is the sole owner of the information collected on this website. GMSity Embroidery only has access to and collects the information you voluntarily provide via email or other direct contacts. GMSity Embroidery will not sell or rent this information to anyone.

• GMSity Embroidery will use your information to respond to you regarding why you contacted GMSity Embroidery. GMSity Embroidery will not share your information with any third party outside of the company other than as necessary to fulfill your request, e.g., to ship an order.

• Unless you ask GMSity Embroidery not to, GMSity Embroidery may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.

REFUND POLICY 

• All sales are final for all digital purchases and embroidered items.

• For digital files, we will replace any corrupt file but cannot offer a refund after the product has been downloaded, sent via electronic means, or a download has been attempted. Our servers carefully monitor downloads to ensure the appropriate products are delivered to our customers.

IMAGE & EMBROIDERED DESIGNS USE 

• You may use my images on your website, blog, or storefront with the following requirements:

• You cannot (re)sell my designs.

• You cannot sell an embroidery design that is derived from a variant of my work without prior consent.

• You must not link, serve or call the image from our server. Commonly referred to as hotlinking or leeching. This consumes my bandwidth. Once this is detected, I will pursue action against the offending party.

• Please do not alter my artwork, for example: by creating alphabets, or creating additional art with parts and pieces of my art. It must remain original.

• You are and remain in compliance with all other Terms and Conditions set forth by GMSity, LLC.

• You must link back to www.gmsembroiderydesigns.com on all products that we provide consent for you to use.

PRODUCT REPLACEMENT 

• All sales are final for all digital purchases and embroidered items.

• If you purchase an item and nothing has been embroidered onto the item, you must contact us within 48 hours of receipt of goods to initiate a return. Contact after 48 hours for a product replacement will not be honored. Receipt of goods is defined from the time and date of delivery by mail services as verified by a delivery confirmation.

• The customer must return the original item. Return shipping from the customer must include delivery confirmation.

• The customer is responsible for return shipping. GMSity Embroidery will pay for the reshipping of the replacement from my facility to the customer location at the lowest available cost that provides delivery confirmation. No express, priority, or expedited shipping unless customers agree to pay shipping charges upfront.

• Delivery confirmation on return shipping must be purchased by the customer and provided to GMSity Embroidery. Return shipping from the customer must include delivery confirmation.

• Failure to purchase and provide delivery confirmation may result in forfeiture of the right to receive a replacement or refund if the item(s) are lost in transit back to our facility.

• Upon receipt of returned good(s), I will inspect, investigate item damage and begin replacement.

• A return claim is denied if my investigation finds that the damage was incurred by misuse, normal use, or any other defect not originating from craftsmanship.

• Items involving any customized embroidery do not qualify for refunds.

• Items will be replaced per the original specifications of the original order. No modifications or adjustments are allowed.

• Replacement item(s) will be made with the original or similar material in quality, colors, threads, and craftsmanship as the initially purchased item(s).
